3-Day Notice to Cure or Quit
The 3-Day Notice to Cure or Quit is also known as a “3-Day Notice to Perform a Covenant or Quit” or a “3-Day Notice to Comply or Quit.” This notice is given to a tenant when a tenant is not following a provision in the rental agreement and the problem can be addressed by the tenant.
Examples of a typical lease provision that can be addressed with this type of notice are noise complaints, cleaning one’s trash from common areas, violation of a no-pet provision, and subleasing violations.
This notice must include the specific provision in the lease that is being violated, or it is invalid.
Some cities require that a “cease-and-desist” letter be sent first before this type of notice is used.
